| General Terms and Conditions (Registration) You must agree to all terms and conditions of this document before registering with CanadianAutoStore.com. CanadianAutoStore.com is herein referred to as CAS. Article 1: Eligibility of Membership - CAS is only available to people who are legally able to form binding contracts with the seller/buyer of an auction item. People who are under the age of 18 are not eligible for membership due to state laws concerning the age of majority. If you do not meet these requirements, you are not eligible to use these auction services. Multiple accounts by the same person are prohibited. Article 2: Due to the inherent nature of vehicles and related items there are many different local, state, and federal laws governing their posession, sale, and shipping. Violation of any of the various laws is strictly forbidden. You must be in compliance with any and all laws when selling or buying using the CAS site! Article 3: CAS is only providing Internet auction services. We only provide services to people interested in selling and buying vehicles, parts via an Internet auction. We do not have control over the items that are posted in the auction site, and cannot guarantee the authenticity and quality of a said product. We are not responsible for the actions that the sellers take before, during, or after the auction, typographical errors, misprints, loss of merchandise/money, damage or failure of equipment, due to your visit to this auction site. Use of this site is at your own risk and content is presented 'As-Is' Article 4: Bidding - As a user, you may bid and/or sell merchandise. As a bidder you know that placing a bid is a binding contract between you and the seller, and the bid cannot be retracted unless due to mistake by the seller, typographical error, human error on the seller's part, or other error. Once you place a bid, and if you win, you will be obligated to buy the product at the said price you indicated as your bid. Placing a bid on this auction site, winning, then not paying for the product is illegal in most states, resulting in possible prosecution. Article 5: Seller - As a seller the item that you place up for bid must be real. Pre-sales are not accepted, you must have the item on hand when you list it for sale. Once a bid has been placed for your item, you have entered into a binding contract with the potential buyer of the product, if that bid shall be the highest bid. Once the auction is over, if over reserve price, you are obligated to sell to the potential buyer which is the highest bidder in your auction. If, reserve price was not met, you are not obligated in any way to sell this item at all. As a seller, you are not legally permitted to bid on your own items. This is known as sham bidding. If you are reported for sham bidding and are found by the CAS staff to be doing so, your auction(s) will be deleted, you will be suspended or terminated, and you will still be responsible for any fees owed to CSA that you initially agreed to pay to use our services. Links to other websites are strictly prohibited! This includes clickable links as well as copy and paste links. Advertising of other websites in any form is prohibited. Keyword spamming is prohibited. Article 6: Prohibited Listings - The sale of merchandise that infringe any third party's intellectual property, including copyright, patent, trademark, or other proprietary rights is prohibited. The use of images or other material that infringe any third party's intellectual property, including copyright, patent, trademark, or other proprietary rights is prohibited. Intentional misrepresentation of items is strictly forbidden. Items that are up for bid are subject to review by the staff of CAS and may be removed without prior notice, if found in violation with this User Agreement. Article 7: Charges - Refer to our Fees Page Article 8: Privacy - We collect your information so that we can provide it to the winners of your auctions or to the sellers of any auctions that you have won. Your personal information will NEVER be sold or rented. Personal information sent to a user regarding a product bought or sold on CAS must not be used for any other purpose, except for communication concerning the auction item. Article 9: Warranty - CAS provides this website on an 'as-is' condition that is without a warranty or condition. CAS is not liable for any damages resulting in an auction, or your visit to the site. Article 10: Violation of any of the terms set forth here will not be tolerated. Any user who violates these terms may have his or her account suspended or banned without notice at our discretion. Article 11: These terms and conditions may be changed at any time without notice. Laws. These Terms of Service shall be governed by and constructed in accordance with the Canadian laws and any disputes will be decided only by the Courts of Canada |
